In this regard, it is further clarified that in case where the main line of business of the exporter has changed after obtaining RCMC from a particular Council, such RCMC shall continue to be acceptable under this Policy, till the expiry of its validity. Meaning thereby, in these cases the exporters shall not be required to obtain a new RCMC from the Council, which is concerned with his new main line of business, till the old RCMC is valid.
In respect of supplies under categories mentioned in paragraphs 8.2(d), (e), (f), (g), (h), (i) & (j) of FTP, claim may be filed either on the basis of proof of supplies effected or payment received. Claims should be filed within a period of twelve months from date of receipt of supplies by project authority or from date of receipt of the payment as per the option of applicant either against a particular project or all the projects.. Claims may also be filed where part payments have been received.
The allocation of duty credit scrips by RA, CLA, New Delhi, under Para 3.8.6 of FTP (RE2007), shall be done proportionate to the eligible claims of individual applications, vis-à-vis the total eligible claims of all the status holders put together, received for each half year (Apr-Sep 2007 / Oct-Mar 2008) period, in such a way that the total benefits granted for all status holders put together does not exceed the limit prescribed for each half year in Para 3.8.6 of FTP (RE2007). Accordingly if the total eligible claim of all the status holders put together is, say, Rs 200 Cr, each applicant status holder would be granted one-fourth of the claim an applicant is eligible for.
In cases where original EP copy of Shipping Bill(s) / Bill of export and/or Bank Realisation Certificates has been submitted under any other scheme of FTP, a self attested photocopy(s) of EP copy of the same be attached, quoting Reference File no. & concerned Regional Authority where original documents have been submitted.
With respect to Focus Product Scheme/High-Tech Products Export Promotion Scheme, it is clarified that Para 4 above shall again apply, as the item which has been restricted / prohibited for exports is obviously ineligible, as the same would no longer remain a Focus Product/High-Tech Product for the purpose of boosting export through grant of benefits (even if the export product is appearing under Appendix 37D/37E of HBP v1).
In exercise of powers conferred under Paragraph 2.4 of the Foreign Trade Policy 2004-2009, the Director General of Foreign Trade hereby makes the following amendments in Handbook of Procedures.
In Appendix 37A, for VKGUY product code No 9.1, 9.4 and 9.12, the Note given in Table 9 of Appendix 37A, relating to sourcing/registration by KVIC/KVIB, shall not apply, for exports w.e.f 1.4.2006. The said note is deemed to be modified to this extent.
In exercise of the powers conferred by Section 5 read with Section 3(2) of the Foreign Trade (Development & Regulation) Act, 1992 (No.22 of 1992) and also read with Para 1.3 and Para 2.1 of the Foreign Trade Policy, 2004-2009, the Central Government hereby makes the following addition with immediate effect at the end of Paragraph 2 of Notification No. 33(RE-2007)/2004-2009, dated 08.10.2007 (pertaining to prohibition on export of wheat and wheat products).
We undertake to abide by the provisions of the Foreign Trade (Development and Regulation) Act, 1992, the Rules and Orders framed thereunder, the Foreign Trade Policy and the Handbook of Procedures.
In exercise of the powers conferred under Paragraphs 2.1, 2.4 and 2.29 of the Foreign Trade Policy, 2004-2009, the Director General of Foreign Trade hereby replaces existing Para 3 of Public Notice No. 61(RE-2007)/2004-2009.
