PPK Newsclick Studio Pvt. Ltd. & Anr. Vs DCIT (Central Circle-1) (Supreme Court of India)
Supreme Court of India has refused to entertain a writ petition filed by PPK Newsclick Studio Pvt. Ltd. and another petitioner under Article 32 of the Constitution against income tax demands. Instead, the Court directed the petitioners to approach the jurisdictional High Court under Article 226. While making no comments on the merits of the case, the Court acknowledged the petitioners’ intent to file a writ petition in the High Court within a week. In the interim, the Court restrained the tax authorities from taking any coercive action against NewsClick for one week. Following this direction, the Supreme Court disposed of the writ petition along with any pending applications.
FULL TEXT OF THE SUPREME COURT JUDGMENT/ORDER
1. We are not inclined to entertain this writ petition under Article 32 of the Constitution of India and leave it open to the petitioners to approach the jurisdictional High Court by way of a writ petition under Article 226 of the Constitution of India. However, we make no comment on the merits, either way, of the assertions made by the petitioners.
3. The learned senior counsel, appearing for the petitioners, states that they would be filing a writ petition under Article 226 of the Constitution of India within one week.
4. The respondents are restrained from taking any coercive action against the petitioners for a period of one week.
5. Recording the aforesaid, the writ petition is disposed of along with pending application(s), if any.
