Jagdish Prasad Mittal Vs.  Union of India (Orissa High Court), Writ Petition No. WP(C)-17178/2015, Date- 21/09/2015

In this case writ is been filed on 21.09.2015 for Non extension of due date of ITR and Tax Audit for Assessment Year 2015-16 by CBDT. The writ is scheduled for Hearing on 23rd September 2015.

Petitioner is a Chartered Accountant from Rourkela and filed his writ under Article 226 & 227 of Companies Act Read with Provisions related to Due Date and Tax Audit Under Income Tax Act, 1961.

25.09.2015- This case is adjourned for Final hearing to 29.09.2015.

29.09.2015- Hearing taken place and Hon’ble High Court has ruled that Order will be pronounced tomorrow i.e. on 30.09.2015. As per our discussion with Petitioner High Court is expected to follow the order of Punjab & Haryanka High Court.

30.09.2015- 12.15 PM- Orissa High Court followes the Judgments of Gujarat and Punjab & Haryana High Court and instructed CBDT to extend due date  to 31.10.2015.

    TAX AUDIT DATE AND INCOME TAX RETURN DATE MUST BE EXTENDED . CBDT IS NOT ISSUEING FROM OF INCOME TAX FROM FEB 2015 (BUDGET) TO AUG-2015. WHY CBDT EXPECT FROM CA TO DO WORK DAY AND NIGHT TO COMPLETE AUDITS.

    Mumbai HC has already declared that judgement given by one HC will be binding on entire India
    In my opinion notifications relating to PH Court and Gujarat HC should be applicable for everywhere otherwise contempt proceedings can be drawn

    I have gone though the orders passed by Hon’ble Punjab and Haryana High Court. The court in its Orders has mentioned to extend the Due date of E-filing of Returns till 31/20/2015. The Hon’ble Court has not mentioned any where for extension of E-Filing of Audit reports

    The Returns can already be filed at any later date, the Binding is of Filing the Audit Report in Time. NOW WE ARE ON MERCY OF THE CNDT

    what is happening in this country
    it is a clear case for extension due date, but no one including courts cares about, what is mean for adjournment on 28 & 29 September.

    31/7/2015 to 30/9/2015

    Law stated 60 days,
    CBDT says 23 days,
    Court says More days required for verdict,
    Where we (Practitioners ) go for justice.
