Directorate General of Foreign Trade (DGFT), under the Ministry of Commerce & Industry, has amended the import policy for Sulfadiazine API (Active Pharmaceutical Ingredient) under ITC(HS) Code 29359013. Effective immediately, the import policy for Sulfadiazine API with a Cost, Insurance, and Freight (CIF) value of less than Rs. 1,774 per kilogram is changed from ‘Free’ to ‘Restricted’. This restriction is temporary and will remain in effect until September 30, 2026. The purpose of this Minimum Import Price (MIP) condition is to regulate the import of the API below a certain price threshold. However, the MIP condition will not be applicable to imports made by entities that are part of export-focused schemes. Specifically, imports by Advance Authorization holders, Export Oriented Units (EOUs), and units in Special Economic Zones (SEZs) are exempted, provided that the imported Sulfadiazine API is not sold into the Domestic Tariff Area (DTA). This measure is implemented under the powers of the Foreign Trade (Development & Regulation) Act, 1992, and the Foreign Trade Policy (FTP) 2023.

Subject: Amendment in Import Policy Condition of Sulfadiazine API covered under Chapter 29 of ITC (HS), 2022, Schedule-I (Import Policy)-regarding.
S.O. 4662(E).—: In exercise of powers conferrea by Section 3 and Section 5 of Foreign Trade (Development & Regulation) Act, 1992, read with paragraph 1.02 and 2.01 of the Foreign Trade Policy (FTP) 2023, as amended from time to time, the Central Government hereby amends the Import Policy Condition of the following HS codes covered under Chapter 29 of ITC (HS), 2022, Schedule — I (Import Policy) with immediate effect, as under:

Effect of the Notification:
Import of Sulfadiazine API under Chapter 29 of ITC (HS), 2022, Schedule — I (Import Policy), having a CIF value o4 less than Rs. 1,774 per kg, is ‘Restricted’ till 30.09.2026, with immediate effect. However, Sulfadiazine API imported by Advance Authorization holders, EOUs, and units in SEZs shall be exempted from MIP condition.
