BBP Studio Virtual Bharat Pvt. Ltd Vs State of Karnataka (Karnataka High Court)

Karnataka High Court held that cancellation of contract by State just before delivery of final product is violation of contract and accordingly writ petition under Article 226 of the Constitution of India against a State or its instrumentality for the same is maintainable.

Facts- The petitioner is a renowned film production house engaged in the business of producing feature films, documentaries, commercials and music videos. Whereas, the respondent is the Invest Karnataka Forum.

Respondent issued work order to showcause the uniqueness of the State of Karnataka through a 3D film during the Global Investors Meet to the petitioner. Accordingly, the petitioner claims to have begun the work and invested huge amount for the creation of 3D film.

On 25-10-2022 the petitioner claims to have been ready to deliver its work to the respondent in completion of the work order dated 11-08­2022. What the petitioner receives from the hands of the respondent is cancellation/withdrawal of the contract/work by a cryptic communication indicating no reason as to why it was being withdrawn.
