The Calcutta High Court considered an application seeking confirmation of interim bail earlier granted to the petitioner on February 18, 2025 on medical and humanitarian grounds, along with a request for waiver of the conditions imposed. The interim bail had been extended from time to time, and it was not alleged that the petitioner misused the liberty or violated any bail condition.
The petitioner contended that he was not named as an accused either in the FIR registered by the CBI in June 2022 or in the ECIR registered by the Enforcement Directorate. He had complied with notices issued under Sections 160 and 91 of the Code of Criminal Procedure and cooperated with the investigation. Although searches were conducted and materials seized from his residence, the CBI’s original charge sheet filed in May 2023 and the first two supplementary charge sheets did not name him as an accused. He was arrested by the ED in May 2023 in connection with a PMLA case and was later interrogated by the CBI while in judicial custody. After conclusion of arguments in his PMLA bail application in November 2024, the CBI sought a production warrant, obtained police custody, recorded his voice sample, and eventually named him as an accused only in the third supplementary charge sheet filed in February 2025.
