Having heard learned counsels for the parties, we direct Shri Rajeev Kumar, Commissioner of Police (CP), Kolkata to appear and make himself available before the investigating agency, namely, the Central Bureau of Investigation (C.B.I.) and to faithfully cooperate with the investigating agency at all times.
However, we make it clear that no coercive steps including arrest shall be taken against the Commissioner of Police.
To avoid all unnecessary controversy, we direct the Commissioner of Police to appear before the investigating agency in Shillong, Meghalaya on such date(s) as may be fixed.
Contempt Petition (C) No. 166/2019 in W.P.(C) No. 401/2013
Issue notice returnable on 20.2.2019.
We direct the Chief Secretary of the State of West Bengal, the Director General of Police and the Commissioner of Police, Kolkata to file their replies to the statements made in the contempt petition on or before 18.2.2019.
We further make it clear that on consideration of the replies of the aforesaid three authorities, the Court may require the personal presence of the said officers on 20.2.2019, which presence, if required, would be intimated to the officers concerned by the Secretary General of this Court on 19.2.2019.
