THE COMMISSIONER OF POLICE GREATER MUMBAI

ORDER

(UNDER SECTION 144 OF CRIMINAL PROCEDURE CODE, 1973)

1. Whereas, in exercise of powers conferred under Section 2 of the Epidemic Diseases Act 1897 read with enabling provisions of the National Disaster Management Act 2005, the Government of Maharashtra, issued directions vide Notification No. DMU/2020/CR.92/ DisM-1. Dated: 13th April 2021 (“Break the Chain”) to take certain emergency measures to prevent and contain the spread of Covid19 virus and to enforce these measures throughout the state,

Whereas, the Government of Maharashtra, issued directions vide Notification No. DMU/2020/CR.92/ DisM-1, Dated: 21st April 2021, 29th April 2021, 12th May 2021, 30th May 2021, 04th June 2021, 25th June 2021, 19th October 2021, 27th November 2021, 24th December 2021 and No. Corona 2021/C.R.366/Arogya-5, Dated: 02nd August 2021, 11th August 2021 and 24th September 2021, to continue measures to prevent and contain the spread of Covid19 virus, and to extend or modify the restrictions that have been imposed from time to time,

Whereas, the Commissioner, Municipal Corporation of Greater Mumbai, has issued Order No. MCG/8326, Dated 24th December 2021, directing that no New Year celebration programme/function/gathering/party/activity or happening in any closed or open space shall be allowed in municipal limits of Greater Mumbai, in order to tighten the measures to prevent and contain the rapid spread of Covid19 virus,

4. Therefore, I, Chaitanya S. , Dy. Commissioner of Police (Operations), Greater Mumbai, and Executive Magistrate, vide powers conferred upon me u/s 144 of the Criminal Procedure Code, 1973 (Act II of 1974) r/w the order of the Commissioner of Police, Greater Mumbai, Dated 23/12/1959 u/s 10 sub section (2) of the Maharashtra Police Act 1951 (Mah. Act XXII of 1951), as I am satisfied that Greater Mumbai continues to be threatened with the Covid19 pandemic, in light of the increase in Covid19 cases and the emergence of the new Covid19 variant “Omicron”, with a view to prevent danger to human life, health or safety, and to curtail the transmission of the Covid19 virus, do hereby prohibit any New Year celebration/programmed/function/gathering/party/activity/ or happening in any closed or space including restaurant, hotels, banquet halls, bars, pubs, orchestras, resorts, clubs,  rooftops etc. The trains, buses and private cars may ply as per the current guidelines and norms.

5. This order shall come into force, in the areas under the control of the Commissioner of Police, Greater Mumbai, from 00.00 Hrs of 30th December 2021 and will remain in force till 24.00 Hrs of 7th January 2022, unless withdrawn earlier.

6. Any person contravening this order shall be punishable under Section 188 of the Indian Penal Code 1860 in addition to penal provisions under the Epidemic Diseases Act 1897 and National Disaster Management Act 2005 and other legal provisions as applicable.

7. As the notice can not be served individually on all concerned, the order is hereby passed ex-parte. It shall be published for the information of the Public, through the Press, or by affixing copies on the Notice Boards of the Police Stations and offices of the Divisional ACsP and Zonal DCsP.
