The writ petitioner challenged the dismissal of his Original Application (OA 29 of 2025) and Miscellaneous Application (MA 70 of 2025) by the Central Administrative Tribunal (CAT), Kolkata Bench. The petitioner was a Senior Private Secretary at the Income Tax Appellate Tribunal, Visakhapatnam, who applied for deputation as Principal Private Secretary (PPS) at the Armed Forces Tribunal (AFT), Kolkata. Following a skill test and interview, he received an appointment letter dated 17-02-2022.
The petitioner could not be relieved by his parent department immediately and was only able to join AFT Kolkata on 16-04-2024, over two years after his appointment, following an order of the CAT, Jabalpur Bench (OA 493 of 2022, dated 19-01-2024). Within six months of joining, he received a three-month notice for repatriation to his parent department, issued on 03-10-2024 by the Registrar, AFT Kolkata, based on communication from the Principal Bench dated 24-09-2024. He initially filed OA 1513 of 2024 challenging this repatriation notice but withdrew it to file a detailed representation, which he submitted on 04-11-2024.
While the representation was pending, the petitioner was relieved by an order dated 02-01-2025, purportedly served by email. He then filed OA 29 of 2025 challenging the repatriation, which the CAT dismissed on 25-03-2025, a decision now challenged before the Calcutta High Court.
