Sanjay Chandra Vs CBI (Supreme Court of India)
In a significant ruling, the Supreme Court of India has granted bail to five corporate executives accused in the 2G spectrum allocation scam. The bench, comprising Justices [Insert Names if available from other parts of the judgment], overturned the Delhi High Court’s decision and emphasized that “bail is the rule and jail is the exception.”
The appellants, Sanjay Chandra (Managing Director of Unitech Wireless), Vinod Goenka (Director of Swan Telecom), Gautam Doshi, Surendra Pipara, and Hari Nair (all senior executives of Reliance ADA Group), were accused of criminal conspiracy, cheating, forgery, and offenses under the Prevention of Corruption Act in connection with the allocation of Unified Access Services (UAS) licenses and spectrum in 2008.
The Central Bureau of Investigation (CBI) alleged that Sanjay Chandra conspired with former Telecom Minister A. Raja and others to secure UAS licenses for Unitech Wireless despite the company’s ineligibility. It was alleged that the first-come-first-served policy was manipulated to benefit Unitech, and Chandra was aware of this design.
Regarding Vinod Goenka, the CBI contended that he continued with fraudulent applications submitted by Swan Telecom’s previous management, knowing the company was ineligible under UASL guidelines. He was accused of colluding with Shahid Usman Balwa to create false documents to facilitate the acquisition of licenses and spectrum in 13 circles.
