Unique Identification Authority of India (UIDAI) has issued the Aadhaar (Authentication and Offline Verification) Second Amendment Regulations, 2024, under the Aadhaar Act, 2016. These amendments, effective from December 3, 2024, modify key provisions of the original 2021 regulations. Updates include changes to definitions, titles, and sub-regulations, enhancing clarity and ensuring alignment with privacy and security standards. For instance, the term “Requesting Entity” has been revised to “requesting entity,” reflecting consistency across regulations. Amendments to regulation 12 emphasize UIDAI’s role in assessing the financial and managerial soundness of applicants to safeguard public data privacy and security. Additional updates in regulations 22 and 23 refine the terminology and scope for entities involved in authentication and offline verification processes. These changes aim to improve regulatory precision while addressing operational aspects of Aadhaar authentication. The updated regulations have been published in the Official Gazette and are now in effect.

No. HQ-13079/10/2024-AUTH-II(E).—In exercise of the powers conferred by sub-sections (1) and (2) of section 54 of the Aadhaar (Targeted Delivery of Financial and Other Subsidies, Benefits and Services) Act, 2016 (18 of 2016), the Unique Identification Authority of India hereby makes the following regulations to further amend the Aadhaar (Authentication and Offline Verification) Regulations, 2021, namely:—
1. Short title and commencement. —
(1) These regulations may be called the Aadhaar (Authentication and Offline Verification) Second Amendment Regulations, 2024.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Aadhaar (Authentication and Offline Verification) Regulations, 2021,—
(a) in regulation 2, in sub-regulation (1), in clause (o), for the words “Requesting entity”, the words “requesting entity” shall be substituted;
(b) in regulation 12,—
(i) in the short title, for the words “Requesting Entities and Authentication Service Agencies”, the words “requesting entity and Authentication Service Agency” shall be substituted; and
(ii) in sub-regulation (6), for the words “the Authority may:”, the following words shall be substituted, namely:—
“the Authority may, if it is satisfied that the general character of management and the financial condition of the applicant are sound for securing the interests of privacy and security of information of the general public,—”;
(c) in regulation 22, in sub-regulation (4), for the words “Requesting Entities, Authentication Service Agencies and Offline Verification Seeking Entities”, the words “Every requesting entity, Authentication Service Agency and Offline Verification Seeking Entity” shall be substituted; and
(d) in regulation 23, in sub-regulation (1), for the words “Requesting Entity”, the words “requesting entity” shall be substituted.
