The Supreme Court of India addressed a petition filed by the National Financial Reporting Authority (NFRA) against Snehal N. Muzoomdar & Anr, concerning the regulatory powers of the NFRA over chartered accountants involved in audits. The central issue revolved around the extent of NFRA’s authority to initiate and continue disciplinary proceedings against auditors, particularly in cases where Audit Quality Review Reports (AQRR) were not prepared. The Supreme Court, after hearing the initial arguments, issued a notice to the respondents, with one respondent accepting the notice through their counsel present at the hearing. The second respondent was considered a proforma respondent and was not required to be served. The court directed the respondents to file their counter affidavit or reply within four weeks, with a subsequent three-week period for the petitioner to file a rejoinder if necessary. The Supreme Court was also informed about the petitioner’s intention to file further special leave petitions against similar judgments passed in other related writ petitions.

Acknowledging the ongoing nature of the legal challenge and without making any definitive pronouncements on the merits of the case, the Supreme Court issued an interim order. This order distinguishes between cases based on the stage of the proceedings. In instances where the NFRA had initiated regulatory proceedings against chartered accountants but had not yet finalized these proceedings by passing a final order, and where no Audit Quality Review Reports were prepared, the Supreme Court permitted the NFRA to continue with these proceedings. However, the crucial caveat was that no final orders would be passed in such ongoing matters until further directions from the court. Furthermore, for cases where the NFRA had already concluded the proceedings and issued final orders against the concerned chartered accountants, the Supreme Court specifically directed that the execution or enforcement of these final orders would be stayed. This interim measure effectively allows the regulatory process to continue in certain inchoate cases while preventing the implementation of concluded actions pending a more comprehensive adjudication of the legal issues raised in the petitions.
