Sarvesh M. Kolumbkar (Competition Commission of India)
The case of Sarvesh M. Kolumbkar vs. Nestle India Ltd. before the Competition Commission of India (CCI) concerned allegations against Nestle India Ltd.’s Bicholim Goa Factory regarding the manufacturing process and labeling of Maggi Sauce. The Informant, Sarvesh M. Kolumbkar, filed the Information under Section 19(1)(a) of the Competition Act, 2002 (the Act), alleging a contravention of Section 4 of the Act, which prohibits the abuse of a dominant position.
The core of the Informant’s grievance was the claim that the Opposite Party (OP), Nestle India, was using a “dirty water extraction pump from an under-construction site” for the production of Maggi Sauce. Furthermore, the Informant alleged that by affixing “false labels” on the bottles, the OP was cheating Indian consumers and denying their right to clean, healthy, and hygienic food. The Informant contended that this “highly objectionable production process” violated the Food Safety and Standards Act, 2006 and its associated rules, though no legal action had been taken by the Directorate of Food and Drugs Administration on the matter.
Allegations of Abuse of Dominant Position
The Informant specifically alleged that by adopting this production process and using false labels, Nestle India had violated the provisions of Section 4 of the Act. Section 4 deals with the Abuse of Dominant Position, which occurs if an enterprise or group, among other things, imposes unfair or discriminatory conditions or prices, limits or restricts production or technical development to the prejudice of consumers, denies market access, or uses its dominant position to protect another relevant market.
