Income Tax Gazetted Officers Association (ITGOA) & Ors. Vs Union of India & Ors. (Supreme Court of India)

Summary: The Supreme Court of India dismissed the Special Leave Petition filed by Income Tax Gazetted Officers Association (ITGOA) and others against Union of India and others, while expressly preserving the petitioners’ opportunity to pursue their grievance before the 8th Pay Commission. The Court first condoned the delay in filing the petition. Upon hearing the counsel representing the petitioners, however, it stated that it was not inclined to entertain the Special Leave Petition and consequently dismissed it. Importantly, the dismissal was accompanied by an express clarification that the petitioners could agitate their case before the 8th Pay Commission in accordance with the procedure prescribed and undertaken by that Commission. The order therefore leaves open the specified Pay Commission process without granting any substantive relief in the Special Leave Petition. The Supreme Court did not record detailed findings on the underlying dispute, examine its merits or direct the Pay Commission to accept the petitioners’ claim. The Court further directed that all pending applications, if any, would stand disposed of. Accordingly, the operative outcome is dismissal of the Special Leave Petition, condonation of the filing delay and preservation of the petitioners’ right to pursue their case through the procedure available before the 8th Pay Commission.

Supreme Court’s Decision

The Supreme Court condoned the delay but declined to entertain the Special Leave Petition filed by the Income Tax Gazetted Officers Association and others. While dismissing the petition, the Court expressly permitted the petitioners to pursue their grievance before the 8th Pay Commission in accordance with its prescribed procedure. The order contains no detailed adjudication of the underlying dispute. Accordingly, the dismissal cannot be presented as an independent determination of the petitioners’ substantive entitlement.
