The Department of Consumer Affairs, Government of India, issued an advisory to all States and Union Territories regarding implementation of recommendations made by the High-Level Committee on Non-Financial Regulatory Reforms constituted by NITI Aayog. The advisory aims to improve ease of doing business, reduce unnecessary compliance burdens, and enhance transparency in the Legal Metrology framework while safeguarding consumer interests. States and UTs have been advised to prescribe suitable eligibility conditions for repairers based on technical competence, infrastructure, experience, and manpower. They may also set appropriate conditions for grant or continuation of registration of repairers with necessary safeguards. Importantly, existing licensed or registered repairers should not be required to undergo fresh registration merely due to revised procedures or regulatory changes. The advisory further recommends adoption of a randomized, risk-based, and computer-assisted verification mechanism for weights and measures to reduce excessive compliance requirements while ensuring integrity, reliability, and accuracy under the Legal Metrology Act, 2009.

Subject: Advisory regarding implementation of recommendations of the High-Level Committee constituted by NITI Aayog on Non-Financial Regulatory Reforms — reg.

Sir/Ma’am,

I am directed to state that the High-Level Committee constituted by NITI Aayog on Non-Financial Regulatory Reforms has made certain recommendations relating to the functioning of repairers under the Legal Metrology framework and strengthening of the verification mechanism of weights and measures.

2. In order to facilitate ease of doing business, reduce avoidable compliance burden, improve transparency and efficiency in regulatory processes and promote a more streamlined implementation framework, the State Governments/UT Administrations are requested to consider the following measures while implementing the provisions of the Legal Metrology Act, 2009 and the rules framed thereunder:

(i) Eligibility conditions for repairers: The State Governments/UTs Administrations may prescribing suitable eligibility conditions for repairers, taking into account factors such as technical competence, availability of requisite tools and infrastructure, experience, manpower and any other conditions considered necessary for ensuring efficient functioning and regulatory compliance, while promoting uniformity and ease of doing business.

(ii) Conditions for registration/continuation of repairers: The State Governments/UT Administrations may prescribe suitable conditions for grant or continuation of registration of repairers, subject to such verification procedures and safeguards as may be considered necessary by the respective State Governments/UT Administrations.

(iii) Continuation of existing repairers: The existing licensed/ registered repairers may be permitted to continue as valid repairers and may not be subjected to fresh registration requirements solely on account of revised procedures, modified eligibility conditions or changes in regulatory requirements.

(iv) Reduction of compliance burden through risk-based selection for verification mechanism: Since periodic verification of all categories of weights and measures may increase the compliance burden on manufacturers, users, and regulatory authorities, the States/UTs may consider introducing a randomized, risk-based and computer-assisted mechanism for selection of a defined percentage of weights and measures for verification, based on objective parameters such as risk profile, compliance history, and other relevant factors considered appropriate by the respective State Governments/UT Administrations.

3. The above measures may be ensured for implementation in a manner consistent with the provisions of the Legal Metrology Act, 2009 and the Rules framed thereunder, while ensuring protection of consumer interests and maintaining the integrity, reliability and accuracy of weights and measures.

4. This issues with the approval of the competent authority.
