Ashok Kumar Sinha Vs Union of India & Ors. (Supreme Court of India)

The case concerns a petition filed before the Supreme Court of India challenging an order dated 30 June 2020 passed by the National Green Tribunal in Original Application No. 42/2020/EZ. The National Green Tribunal had dismissed the original application filed by the petitioner on the ground that the pleadings lacked material particulars regarding alleged violations and the identities of the violators. The earlier application had been permitted to be withdrawn with liberty to file a fresh application containing the necessary details. However, when the fresh application was filed, the tribunal found that it still lacked specific particulars and therefore dismissed it.

The matter later came before the Supreme Court, where various interim orders were passed during the course of the proceedings. In an order dated 1 December 2023, the Court recorded submissions made on behalf of the State of Bihar that unauthorized constructions adjacent to the banks of the River Ganga in and around Patna had been identified and steps were being taken to remove them. The Court directed the State to file an affidavit through the Chief Secretary reporting the progress in removing such unauthorized constructions and also directed that no further construction should take place near the river banks in the specified area.
