In this writ petition before the Allahabad High Court, the petitioner sought two principal reliefs: a direction to the Regional Officer of the Uttar Pradesh Pollution Control Board (UPPCB) to decide his representation dated 17.03.2025 within a fixed time, and a further direction to cancel the licence issued to Shiv Bricks Field, Kudhana, Brick Kiln No. 15, situated in District Shamli. The petitioner’s case is rooted in a series of partnership arrangements concerning the establishment and operation of a brick kiln originally set up through an agreement dated 29.09.2014 with other individuals. He obtained an Air Pollution Control clearance valid from 31.12.2014 to 31.12.2019.
The petitioner states that over time, various partners were inducted, including Ajit Kumar in 2015 and later Gaurav Malik, Nitin Kumar Tomar, and Vikas through a partnership deed executed on 01.10.2020. Internal disputes arose thereafter, during which the petitioner temporarily withdrew and transferred his share to Awadhesh Kumar but later rejoined once the disputes were resolved. On 24.08.2023, a fresh partnership deed was executed between the petitioner and the other partners for GST-related submissions. However, he alleges that the other partners fraudulently executed another deed on the same day by removing his name without consent and procured a GST registration based solely on their names.
