The case began with the interception of a goods vehicle bearing Registration No. AP21-TY-3126 at Bommasandra Industrial Area, more than 20 kilometers away from its designated destination in Bengaluru city. The Commercial Taxes Officer (CTO) recorded the driver’s statement and inspected the goods. The issue arose because the goods were supposed to be delivered to various places in Bengaluru as per the documents, but the vehicle was intercepted at a different location.

The CTO, upon verification, found discrepancies between the movement of the goods and the details provided in the documents such as e-Way Bills. This led the authorities to conclude that the goods were being transported without proper documents or with defective documents, which contravened the GST Act, 2017. Consequently, they imposed a substantial tax liability and penalty on the transporter, which was upheld in the appellate proceedings within the department.

In response, the transporter filed W.P. No. 7226/2022 (T-RES) before the High Court, challenging the tax and penalty orders. The Single Judge of the High Court favored the transporter’s petition, quashing the tax liability and penalty and ordering the release of the vehicle. Dissatisfied with this decision, the State appealed through an intra-court appeal.
