Introduction: The Financial Intelligence Unit India (FIU IND) has taken decisive action against offshore Virtual Digital Assets Service Providers (VDA SPs) for non-compliance with the Prevention of Money Laundering Act (PMLA) 2002. In response to their illegal operations, compliance Show Cause Notices have been issued. The Ministry of Finance is actively involved in addressing this issue, with a focus on enhancing the Anti Money Laundering/Counter Financing of Terrorism (AML-CFT) framework.

Detailed Analysis: As of March 2023, VDA SPs were brought under the AML-CFT framework, aligning with the provisions of the PML Act. In a significant move, FIU IND has issued Show Cause Notices to nine offshore entities, including well-known platforms like Binance, Kucoin, Huobi, Kraken, Gate.io, Bittrex, Bitstamp, MEXC Global, and Bitfinex. The non-compliance of these entities has prompted FIU IND to take regulatory action.

The obligation for VDA SPs to comply with the PMLA 2002 is not contingent on physical presence in India. This regulation mandates reporting, record-keeping, and registration with FIU IND. Despite serving a substantial user base in India, several offshore entities were operating without registering, thereby avoiding AML and CFT obligations. In response, FIU IND’s compliance actions aim to bring these entities within the regulatory framework.

Director FIU IND has escalated the matter to the Ministry of Electronics and Information Technology, urging the blocking of URLs associated with these entities. This measure is crucial to curbing the illegal operations and ensuring compliance with the PML Act in India.

FIU IND writes to Ministry of Electronics and Information Technology to block URLs of the nine entities operating illegally without complying with the provisions of PML Act in India

Virtual Digital Assets Service Providers (VDA SPs) were brought into the ambit of Anti Money Laundering/Counter Financing of Terrorism (AML-CFT) framework under the provisions of the Prevention of Money Laundering Act (PML) Act, 2002 in March 2023.

As part of compliance action against the offshore entities, Financial Intelligence Unit India (FIU IND) has issued compliance Show Cause Notices to following nine offshore Virtual Digital Assets Service Providers (VDA SPs) under Section 13 of the Prevention of Money Laundering Act, 2002 (PMLA).

Director FIU IND has written to Secretary, Ministry of Electronics and Information Technology to block the URLs of said entities that are operating illegally without complying with the provisions of the PML Act in India.

Virtual Digital Asset Service Providers (VDA SPs) operating in India (both offshore and onshore) and engaged in activities like exchange between virtual digital assets and fiat currencies, transfer of virtual digital assets, safekeeping or administration of virtual digital assets or instruments enabling control over virtual digital assets etc. are required to be registered with FIU IND as Reporting Entity and comply with the set of obligations as mandated under Prevention of Money Laundering Act (PMLA) 2002. The obligation is activity-based and is not contingent on physical presence in India. The regulation casts reporting, record keeping, and other obligations on the VDA SPs under the PML Act which also includes registration with the FIU IND.

Till date 31 VDA SPs have registered with FIU IND. However, several offshore entities though catering to a substantial part of Indian users were not getting registered and coming under the Anti Money Laundering (AML) and Counter Financing of Terrorism (CFT) framework.
