  1.   4. Filling Vacancies through Merit-Cum-Seniority: Any unfilled LDCE-reserved vacancies will be filled through regular promotions on a merit-cum-seniority basis for the respective year.

  5. Vacancy Calculation Based on Cadre Strength: The Supreme Court emphasized that vacancies for LDCE must be calculated based on cadre strength rather than ad hoc methods.

  6. Comprehensive Suitability Assessments: High Courts and State Governments were instructed to formulate detailed rules for assessing the suitability of candidates for promotions. Factors such as legal knowledge, judgment quality, Annual Confidential Reports (ACRs), case disposal rates, viva voce performance, communication skills, and general awareness should be considered.

  7. Eligibility for Civil Judge (Junior Division): Candidates aspiring for the post of Civil Judge (Junior Division) must have a minimum of three years of legal practice. Certification of practice must be endorsed by judicial officers or senior advocates with a standing of at least 10 years. Experience as a law clerk will also be considered.

  8. Mandatory Training for Junior Judges: Newly appointed Civil Judges (Junior Division) must undergo at least one year of training before presiding over a court.

  9. Practice Duration Calculation: The period of legal practice required for eligibility will be calculated from the date of provisional enrollment with the respective State Bar Council.

  10. Exemption for Ongoing Processes: The new rules regarding minimum years of practice will not apply to recruitment processes initiated before the date of this judgment.

  11. Timeline for Amendments: The High Courts are required to implement these amendments within three months, and State Governments must approve them within an additional three months.
