Sujit Paswan Vs State of Bihar (Patna High Court)
Summary : The Patna High Court rejected the regular bail application of Sujit Paswan @ Sujit Pasman in a cyber-fraud case arising from alleged deception of an investor through purported share-market profits. The application related to Buxar (Cyber) P.S. Case No. 05 of 2023, registered under Sections 419, 420, 467, 468 and 471 of the Indian Penal Code and Sections 66, 66C and 66D of the Information Technology Act. Justice Ritesh Kumar passed the order on 27 October 2026.
According to the prosecution, the informant received a call on 15 June 2023 inviting him to open a demat account and invest in shares. He was told that 25% of the profits would have to be paid before he could withdraw the balance. After small deposits and purported profit payments, the caller sent a screenshot showing a profit of Rs. 1,29,597 and demanded further amounts. Another caller subsequently demanded 18% as GST, which the informant did not pay. The alleged deposits by the informant totalled Rs. 82,500.
The petitioner denied involvement. His counsel submitted that he worked as a labourer under another accused, Jimmy Agrawal, who allegedly obtained his documents on the pretext of arranging employment and opened a bank account in his name without his knowledge. Counsel stated that the petitioner had appeared before the police voluntarily, had been in custody since 17 June 2026 and had no criminal antecedents.
The Cyber Crime Security Unit opposed bail, submitting that transactions totalling Rs. 62,24,869 had been credited to the account maintained in the petitioner’s name with Ratnakar Bank in Kolkata and that the lien amount was Rs. 79,76,279. The State also opposed the application, relying on the investigation and alleged cheating.
The Court noted that the FIR initially named unknown persons but that the petitioner’s name emerged during investigation. The case diary indicated that Rs. 10,000 from the informant had reached the bank account in the petitioner’s name, substantial sums had moved through it within a short period, 16 complaints had been lodged against that account in different states, and three criminal cases were pending in connection with it. The investigating agency had frozen the account.
Having considered these circumstances, the High Court held that the substantial transactions and connection of the account to the informant’s payment suggested the petitioner’s involvement in the alleged offence. It therefore declined to grant bail. The order concerns the bail request and does not constitute a final determination of criminal guilt or of any GST liability.
