The Government of Maharashtra has issued an amendment to the Maharashtra Shops and Establishments (Regulation of Employment and Conditions of Service) Rules, 2018, under Notification No.MS&EA-08/2021/C.R.153/Labour-10, dated July 22, 2024. This amendment, published in the Maharashtra Government Gazette, introduces the requirement for establishments to include an insurance certificate in various forms and schedules. The amendment mandates the inclusion of insurance certificate details in Forms A, D, F, and R, and requires copies of the insurance certificate to be appended in the relevant parts of the Schedule. This change aims to ensure that establishments comply with insurance requirements to better safeguard their operations and employees.

In pursuance of clause (3) of article 348 of the Constitution of India, the following translation in English of the Government Notification No.MS&EA-08/2021/ C.R.153/Labour-10, dated 22nd July, 2024 published in the Maharashtra Government Gazette, Part I-L, Extra Ordinary is hereby published under the authority of Governor.

Notification

Maharashtra Shops and Establishments (Regulation of Employment and Conditions of Service) Act, 2017.

No. MS&EA-08/202 1/C.R. 153/Labour-10.— In exercise of the powers conferred by sub-section (1) of section 37 of the Maharashtra Shops and Establishments (Regulation of Employment and Conditions of Service) Act, 2017 (Mah. LXI of 2017), and of all other powers enabling it in this behalf, the Government of Maharashtra, hereby makes the following rules further to amend the Maharashtra Shops and Establishments (Regulation of Employment and Conditions of Service) Rules, 2018, the same having been previously published as required by sub-section (2) of section 37 of the said Act.

1. These rules may be called the Maharashtra Shops and Establishments (Regulation of Employment and Conditions of Service) (Amendment) Rules, 2024.

2. In Form- ‘A’ appended to the Maharashtra Shops and Establishments (Regulation of Employment and Conditions of Service) Rules, 2018 (hereinafter referred to as “the principal Rules”), after entry 13, the following entry shall be inserted, namely :-

“13A Insurance certificate of establishment.”. :-

3. In Form-‘D’ appended to the principal Rules, after entry 13, the following entry shall be inserted, namely :-

“13A Insurance certificate of establishment.”. :-

4. In Form-‘F’ appended to the principal Rules, after entry 11, the following entry shall be inserted, namely:-

“1 1A Insurance certificate of establishment.”. :-

5. In Form-‘R’ appended to the principal Rules, after entry 7, the following entry shall be inserted, namely :-

“7A Insurance policy number and date of validity of insurance policy of establishment.”. :-

6. In SCHEDULE appended to the principal Rules,-

(1) in PART-A, in entry (A), after sub-entry (3), the following sub-entry shall be inserted, namely :-

“(3A) Copy of insurance certificate of insurance of the establishment.”;

(2) in PART-B, in entry (B), after sub-entry (4), the following sub-entry shall be inserted, namely :-

“(4A) Copy of insurance certificate of insurance of the establishment.”;

(3) in PART-C, in entry (C), after sub-entry (2), the following sub-entry shall be added, namely :-

“(3) Copy of insurance certificate of insurance of the establishment.”.
