The Insolvency and Bankruptcy Board of India (IBBI) has notified the Insolvency and Bankruptcy Board of India (Insolvency Resolution Process for Corporate Persons) (Third Amendment) Regulations, 2025. Effective from 1st June 2025, the amendment revises Regulation 40B concerning the filing of forms during the Corporate Insolvency Resolution Process (CIRP). The amendment introduces a structured format and timeline for submitting six forms (CP-1 to CP-5) via an electronic platform. These forms cover various stages of CIRP—from commencement, constitution of the Committee of Creditors (CoC), resolution plan details, and monthly updates, to reporting of avoidance transactions. Specific timelines have been set, generally requiring submission by the 10th day of the following month, with CP-3B requiring submission within 7 days of an adjudicating authority’s decision. The amendment also stipulates that resolution professionals must ensure accuracy and completeness of submissions. A late fee of ₹500 per form per calendar month will apply for delays, starting from a date to be notified separately. Non-compliance, including failure to file, inaccurate data, or delays, may lead to regulatory action, such as refusal to issue or renew Authorisation for Assignment. This amendment is part of IBBI’s continued effort to streamline reporting and accountability in corporate insolvency proceedings, following the previous amendment dated 3rd April 2025.

No. IBBI/2025-26/GN/REG126.— In exercise of the powers conferred by clause (t) of sub- section (1) of section 196 read with section 240 of the Insolvency and Bankruptcy Code, 2016 (31 of 2016), the Insolvency and Bankruptcy Board of India hereby makes the following regulations to further amend the Insolvency and Bankruptcy Board of India (Insolvency Resolution Process for Corporate Persons) Regulations, 2016, namely:-
1. (1) These regulations may be called the Insolvency and Bankruptcy Board of India (Insolvency Resolution Process for Corporate Persons) (Third Amendment) Regulations, 2025.
(2) They shall come into force on 1st June, 2025.
2. In the Insolvency and Bankruptcy Board of India (Insolvency Resolution Process for Corporate Persons) Regulations, 2016, for regulation 40B, the following regulation shall be substituted, namely: –
“40B. Filing of Forms.
(1) The interim resolution professional or resolution professional, as the case may be, shall file the Forms, along with the enclosures thereto, on an electronic platform of the Board, as per the timelines stipulated against each form, in the table below:-

(2) The Board shall make available the Forms referred in sub-regulation (1) on the electronic platform and may modify them from time to time.
(3) The interim resolution professional or resolution professional, as the case may be, shall ensure that the Forms and its enclosures filed under this regulation are accurate and complete.
(4) The filing of a Form under this regulation after the due date of submission, whether by correction, updation or otherwise, shall be accompanied by a fee of five hundred rupees per Form for each calendar month of delay from a date to be notified through circular by the Board in this regard.
(5) The interim resolution professional or resolution professional, as the case may be, shall be liable to any action which the Board may take as deemed fit under the Code or any regulation made thereunder, including refusal to issue or renew Authorisation for Assignment, for-
(i) failure to file a Form along with requisite information and records;
(ii) inaccurate or incomplete information or records filed in or along with a Form;
(iii) delay in filing the ”
