The Food Safety and Standards Authority of India (FSSAI) has notified the Food Safety and Standards (Licensing and Registration of Food Businesses) Second Amendment Regulations, 2026, effective from the date of publication in the Official Gazette. The amendments follow public consultation on the draft regulations issued in January 2026 under Section 92 of the Food Safety and Standards Act, 2006. The first amendment revises the conditions of licence by requiring food manufacturing businesses to maintain daily records of production and separate records of raw material utilisation, while expressly exempting non-manufacturing food businesses from this obligation. The second amendment modifies hygienic and sanitary practices relating to storage by mandating that raw materials, ingredients, work-in-progress, and processed, cooked, or packaged food products be managed according to the First In First Out (FIFO) and First Expire First Out (FEFO) principles. However, retailers are specifically exempted from complying with the FIFO and FEFO storage requirement.

NOTIFICATION

New Delhi, the 23rd June, 2026

F. No. REG-11013/1/2026-Regulation-FSSAI.—Whereas a draft of the Food Safety and Standards (Licensing and Registration of Food Businesses) Amendment Regulations, 2026, was published as required under sub-section (1) of section 92 of the Food Safety and Standards Act, 2006 (34 of 2006) vide notification number F.No. REG-11013/1/2026-Regulation-FSSAI, dated the 23rd January, 2026, in the Gazette of India, Extraordinary, Part III, section 4,dated the 27th January, 2026, inviting objections and suggestions from the persons likely to be affected thereby, before the expiry of the period of thirty days from the date on which the copies of the Official Gazette containing the said notification were made available to the public;

And whereas the copies of the said notification were made available to the public on the 27th January, 2026;

And whereas, the objections and suggestions received from the public in respect of the said draft regulations have been considered by the Food Safety and Standards Authority of India;

Now, therefore, in exercise of the powers conferred by clause (o) of sub-section (2) of section 92 read with section 31 of the Food Safety and Standards Act, 2006(34 of 2006) the Food Safety and Standards Authority of India, with the previous approval of the Central Government, hereby makes the following regulations further to amend the Food Safety and Standards (Licensing and Registration of Food Businesses) Regulations, 2011, namely: –

1. (1) These regulations may be called the Food Safety and Standards (Licensing and Registration of Food Businesses) second Amendment Regulations, 2026.

(2) They shall come into force on the date of their publication in the official Gazette.

2. In the Food Safety and Standards (Licensing and Registration of Food Business) Regulations, 2011,-

(a) in Schedule 2, in Annexure 3 under the heading of Conditions of License, for serial number 8 and entries relating thereto, the following shall be substituted, namely:-

“8. Maintain daily records of production, raw materials utilization separately:

Provided that this condition shall not be applicable to non-manufacturing food businesses.”;

(b) in Schedule 4, in Part-II, in heading of General Requirements on Hygienic and Sanitary Practices to be followed by all Food Business Operators applying for License, under sub-heading FOOD OPERATIONS AND CONTROLS, for paragraph 5.2.5, the following requirement shall be substituted, namely:-

“5.2.5 The storage of raw materials, ingredients, work-in-progress and processed or cooked or packaged food products shall be subjected to First in First out, First Expire First Out, which shall not be applicable to retailers.”.

Note:- The Food Safety and Standards (Licensing and Registration of Food Business) Regulations, 2011 were published in the Gazette of India, Extraordinary, Part III, Section 4, vide number F. No. 2-15015/30/2010, dated the 1st August, 2011 and last amended vide notification number F. No. RCD-01002/ 1/ 2021-Regulatory-FSSAI-Part(1), dated 10th March, 2026.
