The Food Safety and Standards Act, 2006 is made with a view to ensure availability of safe and wholesome food for human consumption. This act received the assent of the President on 23rd August, 2006 and applicable from 24th August 2006.

Food Safety and Standards Authority of India has been established by the Central Government for the implementation of this act. It is a body corporate having its head office at Delhi.

1. Who needs to get Food Registration

Petty Manufacturer, Petty Retailer, Hawker, Temporary Stall Holder, Itinerant Vendor, Tiny Food Business Operator are required to get Food Registration issued by FSSAI before commence or carry-on Food Business.

2. Who needs to get Food License

Every Person other than above-mentioned is mandatorily required to get Food License issued by FSSAI before commence or carry on any Food Business. Any person who wants to get Food License may make an application for grant of License to the Designated Officer of concerned area. An appeal against the order of rejection for the grant of license shall lie to the Commissioner of Food Safety of that State.

3. Documents required for Food Registration

Photo

Aadhaar Card/PAN Card/Voter ID

Proof of Address of Business Premises (Rent Agreement/Electricity Bill, etc.)

Self-Declaration

All these above-mentioned documents except Photo should be self-attested by the applicant.

4. Documents required for Food License

Photo of Proprietor/Partners/Directors

Aadhaar Card/PAN Card/Voter ID of Proprietor/Partners/Directors

Proof of Address of Business Premises (Rent Agreement/Electricity Bill, etc.)

Self-Declaration/Partnership Deed/Memorandum & Articles of Association

Form-IX (Nomination of Person)

5. Prices for Food Registration & License

The Govt. Fee for Food Registration & License is depending on Food Business Nature and Category. Generally, Govt. Fees for Food Registration is Rs. 100 and for State License is Rs. 2500 and for Central License is Rs. 7500.

6. Time Period for Food Registration & License

Generally, Food Registration can be issued within 7-10 Days and State License and Central License can be issued within a time period of 30 Days.

7. Rejection of application of Food Registration & License

If Food Registration/License application has been rejected by the Designated Officer of concerned area then applicant can file an appeal against the rejection order before the Commissioner of Food Safety of that State and no order shall be passed without giving the reasonable opportunity of being heard.

8. Punishment for carrying out a business without License

If any person carries on or commence any Food Business without getting Food License then he shall be punishable with imprisonment for a term which may extend to 6 months and also with a fine which may extend to Rs. 500000.
