The proposed name is not according to the activities described in Main Objects
The proposed Name is not available because of the existence of identical or closely resembling companies
The proposed name is too general without any distinct word or identity
Keywords like Industry/Udyog, Enterprises, Products, Business, Manufacturing
The proposed name does not include the suitable prefix
The proposed name includes words like National, Central, Union, Federal, etc which are considered undesirable
The Companies Act, 2013 furnishes the ensuing guidelines that can save us from rejection or re-submission of a name.
Attributes to be saved in mind for Name Application to avoid Resubmission / Rejections Matters to be ignored while likening the names as per the MCA name availability guidelines (MCA naming guidelines)-
It should be overlooked whether a word is in the plural or singular number in one or both names.
For e.g., Ayurvedic commodity Ltd is similar to Ayurvedics commodity Ltd or Ayurvedic commodities Ltd.
The style and case of letters, spacing between letters, punctuation marks and special characters used in one or both names shall be ignored.
E.g., XYZ Ltd. is the same as X.Y.Z. Ltd. and X Y Z Ltd.
The usage of distinct tenses in the names shall also be ignored.
E.g., Shine stars and Shining stars.
Use of the definite or indefinite article in one or both names.
E.g., Travel Company Ltd. is the same as The Travel Company Ltd. and A Travel Company Ltd.
Word or expression which can be used only after obtaining previous approval of the Central Government
According to MCA name availability guidelines, following words and combinations thereof shall not be used in the Name of a company in English or any of the languages depicting the same meaning unless the previous approval of the Central Government has been obtained for the use of any such word or expression:
- Board;
- Commission;
- Authority;
- Undertaking
- National;
- Union;
- Central;
- Federal;
- Republic;
- President;
- Rashtrapati;
- Small Scale Industries;
- Khadi and Village Industries Corporation;
- Financial Corporation and the like;
- Municipal;
- Panchayat;
- Development Authority;
- Prime Minister or Chief Minister;
- Minister;
- Nation;
- Forest corporation;
- Development Scheme;
- Statute or Statutory;
- Court or Judiciary;
- Governor;
- the use of word Scheme with the name of Government (s), State, India, Bharat or any Government authority or in any manner resembling with the schemes launched by Central, State or local Governments and authorities; and
Bureau.
