Rajasthan High Court Issues Notice and Grants Interim Stay on Tax Recovery Against CG Tollway Ltd
In this matter, the petitioner challenged tax recovery proceedings initiated pursuant to earlier assessment orders, contending that coercive steps were being taken against it. On hearing the petitioner, the High Court issued notices to the respondents, with the State’s counsel accepting notice on behalf of the State authorities, and directed issuance of notice only to the Union of India. Importantly, the Court granted interim protection to the petitioner by ordering that no coercive action be taken for recovery of the disputed tax amount until the next date of hearing. The case was thus posted for further consideration after the respondents file their replies.
FULL TEXT OF THE JUDGMENT/ORDER OF RAJASTHAN HIGH COURT
1. Heard learned counsel for the petitioner.
2. Issue notice. Issue notice on stay application also, returnable in four weeks.
3. Shri Mahaveer Bishnoi, AAG accepts notice on behalf of the respondent Nos.2 to 5, therefore, notice need not be issued to them.
4. Issue notice to respondent No.1 only. In addition learned counsel for the petitioner may supply copy of the writ petition to the standing counsel for Union of India, returnable on 11.09.2025.
