Customs Authority for Advance Rulings (CAAR) in Mumbai has determined that four models of ultrasonic flow meters imported by GE Oil & Gas India Private Limited are to be classified as measuring instruments under Customs Tariff Heading (CTH) 9026. The authority rejected the contention that they should be classified as parts of automatic controlling apparatus under CTH 9032, providing significant clarification on the distinction between measurement and control functions for customs purposes.

The ruling concerned four specific models intended for gas applications: DigitalFlow GC868, DigitalFlow GF868, PanaFlow, and TransPort PT878GC. The core issue was whether these devices, which measure the flow rate of gases, should be treated as simple flowmeters or as integral components of larger automated control systems.

The Central Dispute: Measurement vs. Control

The applicant, GE Oil & Gas, argued that the primary and sole function of the imported goods is to measure the flow rate of gas. The devices operate using the “transit time” ultrasonic method. While three of the models (DigitalFlow GC868, DigitalFlow GF868, and PanaFlow) can transmit this measured data digitally to third-party systems via protocols like MODBUS or HART, they do not themselves perform any control or regulation. The applicant stressed that these meters only provide the initial data, which may then be used by separate, downstream equipment to regulate flow. The fourth model, TransPort PT878GC, is a portable device limited to only measuring and displaying the flow rate.
