Madhya Pradesh High Court addressed a writ petition filed by Birla Corporation Limited seeking the quashing of an order dated July 11, 2023, and a refund of tax payments with interest. The case stemmed from proceedings initiated under Sections 201(1) and 201(1A) of the Income Tax Act for alleged non-deduction of tax at source on payments related to purchases and services. Despite repeated appeals and favorable rulings from the Income Tax Appellate Tribunal (ITAT), the Income Tax Department delayed processing refunds, citing procedural limitations on the TRACES Portal. The petitioner sought redress for the withheld refunds amounting to over ₹5.25 crore, deposited under protest during ongoing proceedings.
The High Court ruled in favor of Birla Corporation, emphasizing the statutory provisions under Sections 240 and 243 of the Income Tax Act, which mandate refunds with interest when determined by appellate orders. It observed that the TRACES Portal’s non-functionality cannot override legal entitlements under the Act. The court directed the Income Tax Department to process the refund or adjust it against outstanding liabilities within 30 days, stressing that administrative hurdles should not obstruct taxpayers’ rights. This judgment reinforces the principle that procedural inefficiencies cannot supersede statutory obligations, ensuring taxpayer relief in cases of undue delay.
