Hindustan Aeronautics Limited Vs Commissioner of Central Excise (CESTAT Kolkata)

The case of Hindustan Aeronautics Limited versus the Commissioner of Central Excise, Customs, and Service Tax Appellate Tribunal (CESTAT) in Kolkata raises significant questions about the validity of a service tax demand over an extended period.

The appellant, a public sector company operating under the Ministry of Defence and owned by the Government of India, contested the imposition of an extended period of limitation in a Show Cause Notice issued on April 19, 2013. The notice alleged suppression of facts during an audit, invoking the extended period for tax recovery.

However, the appellant vehemently denied any deliberate suppression of material information, arguing that any misclassification as “Export of Service” was due to misunderstanding rather than an intent to evade duty. They emphasized their compliance with statutory requirements, indicating a possible misinterpretation rather than a deliberate act of concealment.

In evaluating the situation, the Tribunal underscored the necessity to establish willful suppression for the charge to be sustained. Referring to legal precedents, including the case of Continental Foundation Joint Venture Holding v. Commissioner of Central Excise, Chandigarh-I, they highlighted that mere omission to provide correct information does not constitute suppression unless it was intentional to evade duty payment.
