Surjit Kumar Dhal Vs State Of Odisha (EOW) (Orissa High Court)

Introduction: The case of Surjit Kumar Dhal, a senior journalist and Editor-in-Chief of “Reporters Today” and “Mahabharat,” presents a complex legal scenario involving allegations of economic offenses. Dhal, seeking bail, challenges the rejection of his bail application by the designated court under the OPID Act, Cuttack. The charges against him, arising from Economic Offense Wing Bhubaneswar P.S. Case No.26 of 2023, are serious, including sections 420/467/468/471/506 of the IPC.

The Allegations: The allegations against Dhal center on accusations of exploiting his status as a journalist to deceive Kalinga Keshari Rath, a real estate entrepreneur. The prosecution asserts that Dhal used his purported connections with government officials to entice Rath into investing significant funds. Allegedly, Dhal promised to expedite Rath’s project approvals through his influence, leading Rath to commit substantial sums to the endeavor. However, Rath claims that Dhal reneged on his commitments, resorting to forgery and extortion instead of fulfilling his promises.

Legal Proceedings: Dhal’s legal battle began with an anticipatory bail application, which was rejected by the court. Subsequently, his Special Leave Petition (SLP) to the Supreme Court met a similar fate. The rejection was primarily due to the ongoing investigation and the serious nature of the charges.
