Introduction: The Directorate General of Foreign Trade (DGFT), under the Ministry of Commerce and Industry, Government of India, has issued Policy Circular No. 08/2023-DGFT on 27th December 2023. The circular addresses a crucial aspect related to the applicability of ad-hoc norms, specifically outlined in Pan 4.12 (vi) of the Handbook of Procedures 2023. This article delves into the key points of the circular and its implications for Regional Authorities, Exporters, and Custom Authorities.

Detailed Analysis: The Policy Circular provides clarification on the applicability of ad-hoc norms, emphasizing that valid ad-hoc norms ratified on or after 01.04.2015 will extend to pending cases or applications filed under the self-declaration scheme. These cases must have been filed on or after 01.04.2015 but prior to the application against which the ratification of such ad-hoc norms was conducted.

It is crucial to note that this clarification does not apply to items listed under Appendix 4P for other applicants. The circular, signed by Deputy Director General of Foreign Trade, Raman Kumar, indicates that these guidelines are issued with the approval of the Competent Authority.

For Regional Authorities of DGFT, Exporters, and Custom Authorities, understanding the nuances of this clarification is vital. The circular aims to streamline processes, ensuring that ad-hoc norms ratified post-2015 are appropriately considered for pending cases under the self-declaration scheme.

Conclusion: In conclusion, Policy Circular No. 08/2023-DGFT provides valuable clarity on the applicability of ad-hoc norms. Exporters, Regional Authorities, and Custom Authorities should take note of this update to ensure compliance with the specified guidelines. The circular’s issuance reflects the commitment of the Directorate General of Foreign Trade to enhance transparency and efficiency in trade-related procedures. Staying informed about such policy updates is essential for all stakeholders involved in foreign trade activities in India.
