Artificial Intelligence (AI)

Artificial intelligence refers to the science of making machines that can think and work like humans. In simple language, Artificial intelligence is the ability of machines to perform tasks that are typically associated with human intelligence, such as learning and problem-solving. 

Emergence of AI

AI is increasingly becoming ubiquitous across industries. Today, AI is being used in nearly every profession and industry.

Indian Judiciary and AI

The Supreme Court has been utilizing an AI-controlled technology to analyze material and make it available to judges for rulings since 2021. However, AI is not involved in the decision-making process. SUVAS (Supreme Court Vidhik Anuvaad Software) is another instrument used by the Supreme Court of India to translate legal filings from English into vernacular languages and vice versa. 

Legal Framework to Regulate AI (Global)

AI presents obstacles and concerns such as ethical quandaries, invasions of privacy, bias, discrimination, and security threats.

To address these obstacles and concerns, a global consortium of AI professionals and data scientists has released a new voluntary framework for producing AI products responsibly. The World Ethical Data Foundation (WEDF) boasts 25,000 members, including employees from companies including Meta, Google, and Samsung. The framework includes 84 questions for developers to consider when beginning an AI project.

However, as the use of AI grows, there is a rising need for specialized legislation to regulate it, eliminate in-built or learned prejudice, and address ethical problems.

Indian Perspective:

As on date, there is no specific law for AI in India. However, critics and lawyers are optimistic and believe that India will match up with the pace of the emerging tech.

Ministry of Electronics and Information Technology (MEITY), is the executive agency for AI-related strategies and has constituted committees to bring in a policy framework for AI.

The Niti Ayog has established seven responsible AI principles, which include safety and reliability, equality, inclusivity, and non-discrimination, privacy and security, transparency, responsibility, and the protection and reinforcement of positive human values. The Supreme Court and other high courts are mandated by the Constitution to uphold fundamental rights, including the right to privacy.  

In India, the primary legislation for data protection is the Information Technology Act and its associated rules. Additionally, the Digital Personal Data Protection Act has been passed by Parliament but has not been enforced yet. 

Conclusion:

Artificial Intelligence is reshaping various facets of society and industry, including the legal landscape. While India is yet to enact specific AI legislation, the emergence of responsible AI principles and ongoing efforts by government agencies suggest a proactive stance in addressing the legal and ethical implications of AI. As AI continues to evolve, the need for comprehensive regulatory frameworks becomes increasingly apparent to ensure fairness, privacy, and ethical use of this transformative technology.
