Subject: Clearance of import consignments where duty is not being reflected in ICES after payment- reg.
Attention of all the Importers/Exporters and stakeholders is invited towards Public Notice no. 28/2023 dated 06.04.2023 issued for clearance of import consignments where duty is not being reflected in ICES after payment wherein only following categories of importers were given the facility of obtaining manual Out of Charge wherein on production of a certificate from the Bank as per Annexure-A, indicating the payment of duty, along with an undertaking that in case duty is not credited to the government account the concerned importer shall deposit the same along with applicable interest, immediately:
A. Importers of Perishable Cargo
B. Importers of Pharmaceutical items which move in Cold Chain
C. Importers of Liquid Bulk Cargo
D. AEO Clients
E. DPD Clients
F. Manufacturers
G. Departments/ PSUs
H. Status Holdersunder Foreign Trade Policy
2. The issues relating to payment of duty through Electronic Cash Ledger have been substantially resolved in last few days. However, representations have still been received from the members of the trade to extend the above facility to all categories of Importers since the issue of payment not reflecting in ICES even after payment of duty, is still not fully resolved.
3. In view of the above scenario and also keeping in mind holiday announced on 14.04.2023 (Friday) under the Negotiable Instruments Act, it has been now decided that the facility of obtaining manual Out of Charge stands extended to all the categories of Importers, subject to following the procedure prescribed vide the said Public Notice No. 28/2023 dated 06.04.2023.
4. Further, keeping in view the need of trade facilitation during the current situation, and in the spirit of the Order No. 01/2023-Customs (N.T.)dated 06.04.2023 and Order No. 02/2013-Customs (N.T.) dated 11-04-2023 issued by the Central Board of Indirect Taxes and Customs, the Custodians and Shipping Lines are directed to waive the demurrage and detention charges till 13.04.2023.
5. All other provisions as mentioned in Public Notice No. 28/2023 dated 06.04.2023 will remain in force and the procedure laid out therein shall be followed scrupulously.
