Article 39(d) of the Constitution of India provides for equal pay for equal work. This right of the person for equal pay for equal work is recognized as a fundamental right by various pronouncements of the Apex Court and the law is settled that the right to equal pay for equal work is a constitutional enforceable right.
FULL TEXT OF THE JUDGMENT/ORDER OF HIMACHAL PRADESH HIGH COURT
By way of present writ petition, the petitioner has prayed for the following substantive reliefs:
“(i) That impugned letter date 01.09.2009, Annexure A-15, and order dated 10.10.2014, Annexure A-17, denying pay parity to the applicant at par with another Librarian, Sh. P.K. Kaushal of the respondent department and Assistant Librarians of Education Department may be quashed.
