ROC Maharashtra Mumbai & Anr Vs. Shailendrajit Charanjit Rai & Anr. (Supreme Court)

On Monday, 06th August 2018, the Honourable Supreme Court has stayed Bombay High Court Interim Order for granting relief to Disqualified Director by admitting Special Leave Petition by Ministry of Corporate Affairs.

According to the interim order of the Bombay High Court, the companies’ directors who had been disqualified by the Ministry of Corporate Affairs (MCA) no longer be considered as disqualified. The Bombay HC directed to the Registrar of Companies to accept the physical documents of the struck off companies whose directors are disqualified and treat them as Voluntary striking off applications.

But now, as per aforesaid stay order of SC, other similar orders issued by various high courts in respect of relief to disqualified directors shall stand stayed.
