Summary: The Insurance Regulatory and Development Authority of India (IRDAI), through Circular No. IRDAI/CIR/MOT/10/2026 dated 2 November 2026, has directed general insurers, excluding stand-alone health insurers and specialised insurers, to implement a four-layer motor insurance policy structure for private cars and two-wheelers from 15 December 2026. The directions follow the Supreme Court’s decision in National Insurance Company Ltd. Vs. Smt. Thungala Dhana Laxmi & Others, Civil Appeal No. 14369/2025. The revised structure distinguishes mandatory third-party liability insurance, optional legal liability cover for occupants and pillion riders, personal accident protection, and optional own-damage insurance. Its objective is to enable vehicle owners to understand available coverage and make informed insurance decisions. Under the circular, insurers must adopt uniform policy wordings and obtain a duly completed customer option form for every policy issued to the specified vehicle category. A Customer Information Sheet must also be issued at the point of sale. Existing policyholders may purchase additional Section II coverage from their current third-party insurer by paying an additional premium, without cancelling their existing motor third-party insurance. The policy schedule must separately disclose coverage and premiums for each section, while the certificate of insurance must comply with the Central Motor Vehicles Rules, 1989. Insurers retain flexibility to innovate and price own-damage coverage, subject to preserving the basic four-layer structure. All policies issued from 15 December 2026 must comply with the revised requirements. Insurers must also complete integration with Bima Sugam by the same date to make the policies available through that platform.
