You hold Bitcoin, and the compliance pressure has increased. Exchanges will feed detailed transaction data to tax authorities under rules that took effect in April 2026, and any mismatch with your own records can prompt notices. Keeping accurate cost dates and transfer details now forms part of ordinary portfolio discipline.
India’s flat 30 percent tax on virtual digital asset gains and 1 percent TDS have remained unchanged while the information requirements have become operational. Prescribed entities must submit statements on crypto-asset transactions. The data trail on your Bitcoin buys, sells and swaps will therefore be more visible to the Income Tax Department than in previous years.

Bitcoin Valuations That Feed Directly Into Reported Data
When you check the live BTC to INR rate, you are looking at the same market figure that can underpin the cost and consideration values exchanges will report. Section 285BAA of the Income-tax Act 1961, inserted by the Finance Act 2025 and carried forward as Section 509 of the Income-tax Act 2025, requires reporting entities to furnish information on crypto-asset transactions in a prescribed statement.
The Central Board of Direct Taxes released a 198-page guidance note on 24 July 2026 that explains how Reporting Crypto-Asset Service Providers must perform due diligence, identify reportable users and file Form 167. Business Standard’s 26 July 2026 report on that note confirms the guidance aligns India with the OECD Crypto-Asset Reporting Framework without altering the existing tax rates.
Your exchange’s records of acquisition cost consideration and timing will sit beside the figures you enter in Schedule VDA. The Central Board of Direct Taxes has already identified ₹888.82 crore in undisclosed virtual digital asset income and issued roughly 44,500 communications under its NUDGE programme. Those numbers were disclosed in parliamentary replies and covered by Moneycontrol and The Hindu BusinessLine in December 2025. They demonstrate that matching of exchange data against returns is already under way.

Reporting Obligations That Shape What Holders Must Retain
Reporting Crypto-Asset Service Providers (RCASPs) must establish tax residency, collect prescribed identification, and report crypto-to-fiat and crypto-to-crypto movements under the Crypto-Asset Reporting Framework (CARF). Form 167 covering the 2026 calendar year falls due on 31 May 2027. Pre-existing users as of 31 December 2025 receive a 12-month due-diligence window, while new users are checked at onboarding. KPMG’s August 2026 flash note on the guidance note records these timelines and confirms that primary responsibility rests with the service providers.
You do not file a separate statement under Section 509. You do need your Schedule VDA and any foreign-asset disclosures to reconcile with the data the department receives. Economic Times coverage of ITR filing rules notes that Section 285BAA already required exchanges to report transactions and that Schedule VDA demands transaction-wise detail rather than aggregates. Only the cost of acquisition is deductible. Losses on one virtual digital asset cannot offset gains on another and cannot be carried forward. The Income-tax Act 2025 preserves those constraints under renumbered provisions.
As this earlier coverage of the Budget 2025 obligation to furnish information on crypto-assets highlighted, the framework under Section 285BAA laid the groundwork for the tighter reporting now live under Section 509.
Penalty Provisions That Enforce Timely and Accurate Statements
Budget 2026 added specific penalties to support the reporting duty. Moneycontrol’s 1 February 2026 report quoted Finance Minister Nirmala Sitharaman stating that the provisions create deterrence for non-furnishing of statements or furnishing of inaccurate information. Failure to file attracts ₹200 per day. Inaccurate information that remains uncorrected can attract a ₹50,000 penalty.
The Enforcement Directorate has attached or seized ₹4,189.89 crore in proceeds linked to crypto-related cases under the Prevention of Money Laundering Act. The same December 2025 parliamentary replies that disclosed the ₹888.82 crore figure also recorded dozens of arrests and prosecution complaints. Virtual asset service providers already submit reports under anti-money-laundering rules. The Section 509 layer supplies an additional structured data feed.
Practical Records That Reduce Matching Risk
- Date and INR value of every acquisition and disposal so the cost base is clear when the 30 percent tax applies.
- Details of crypto-to-crypto swaps because each leg can constitute a transfer for both tax and reporting purposes.
- Evidence of airdrops, staking rewards or gifts because the moment you receive them can create taxable income and set a new cost base for later sales.
- Separate records for any overseas wallets or exchanges since foreign holdings may need disclosure in Schedule FA and will be easier for the tax department to see once automatic exchange under the Crypto-Asset Reporting Framework starts in 2027.
- Copies of your exchange statements and TDS credits so you can match them against Form 26AS or the Annual Information Statement when you file.
Maintaining these items lowers the chance of a discrepancy when the department compares your filing with Form 167 data.
Market Activity That Continues to Generate Reportable Events
Binance Research analysis of recent cycle behaviour shows Net Unrealized Profit/Loss bottoming at 0.09 rather than the deeper negative readings recorded in earlier bear markets. The path has been shallower, and certain recovery signals have appeared sooner than in prior cycles. Data from crypto exchange Binance continues to reflect active trading interest. That activity still produces transfers that fall within the reporting perimeter even while the tax computation rules remain unchanged.
The relative firmness of holder metrics does not reduce the importance of accurate Indian records. It simply indicates that many positions may still generate taxable events under the existing 30 percent regime.
Automatic Exchange Timeline and the Immediate Priority
India has committed to the OECD Crypto-Asset Reporting Framework, with automatic exchange expected from April 2027. Domestic Section 509 reporting serves as the bridge. Once foreign platforms begin transmitting data, the visibility gap that previously existed for offshore holdings narrows. Tax is still calculated under the same rules, yet the supporting evidence becomes easier for authorities to verify.
Align your Bitcoin acquisition history and any outstanding foreign-asset disclosures with the statements already available from your platforms before the next filing season. The rules favour those who treat the reporting layer as routine portfolio administration.
