The Telangana High Court considered a criminal petition seeking directions to shift the petitioner from Osmania General Hospital to KIMS Hospital, Hyderabad, during his judicial remand. The petitioner was an accused in HQ POR Nos. 13 and 14 of 2026-CusPrev for offences under Sections 132 and 135 of the Customs Act, 1962. He was arrested on 15.07.2026 and remanded to judicial custody the same day.
The petitioner’s counsel submitted that he was suffering from high blood pressure, severe chest pain, breathing difficulties and excessive sweating. He had been shifted to Osmania General Hospital for treatment. A representation dated 28.07.2026 was submitted by his cousin to the Resident Medical Officer seeking his transfer to KIMS Hospital for better treatment. The petitioner undertook to bear the medical expenses and comply with conditions imposed by the Court.
The respondent opposed the request, submitting that Osmania General Hospital had not passed any order pursuant to the representation and that no evidence had been produced to establish that the hospital lacked necessary medical equipment or facilities.
The High Court noted that the petitioner’s medical condition was recorded in the Memorandum of Grounds. The material also showed that he had been admitted to Osmania General Hospital on 17.07.2026 following serious health complications, discharged on 23.07.2026, and admitted again on 25.07.2026 with severe chest pain. The representation stated that he was a cardiac patient receiving Non-Invasive Ventilatory (NIV) support for six months and that doctors had advised consultation with a Pulmonology Specialist at the earliest.
