The Institute of Company Secretaries of India (ICSI), through its President CS Pawan G. Chandak, has requested the Ministry of Corporate Affairs (MCA) to provide urgent relief to stakeholders affected by persistent technical disruptions on the MCA portal following the recent fire incident at the MCA Data Centre and the subsequent shift to the Disaster Recovery (DR) site. The representation highlights several operational difficulties, including frequent account lockouts, password reset issues, inability to resubmit forms, delays in company incorporations due to expiring name reservations, non-functional e-form saving and downloading features, and continued portal instability affecting statutory compliance. To mitigate these challenges, ICSI has urged the Ministry to extend the validity of RUN/SPICe+ name reservations, avoid rejecting forms pending resubmission because of technical glitches, grant extensions for statutory filing and resubmission deadlines, and issue a clarification exempting stakeholders from non-compliance under the Companies Act, 2013 where delays are solely attributable to MCA portal issues.

Subject: Request for relief to the stakeholders facing practical difficulties due to fire incidence at MCA Data Centre site

Greetings from the Institute of Company Secretaries of India!
This is to respectfully draw your kind attention to the persistent technical disruptions being faced on the Ministry of Corporate Affairs (MCA) portal following the recent fire incident at the MCA Data Centre. As communicated by the Ministry, an unscheduled switchover to the Disaster Recovery (DR) site was undertaken as a precautionary measure. However, several critical functionalities of the MCA portal are yet to be fully stabilised.
In this regard, it is submitted that stakeholders, including professionals and corporates, are encountering significant operational challenges in carrying out routine statutory and compliance-related activities. The key issues experienced on the MCA portal include, inter-alia:
> Frequent locking of user accounts and considerable difficulty in resetting passwords;
> Inability to resubmit forms within prescribed timelines due to login and system-related constraints;
> Delays in incorporation processes, with several approved company name reservations approaching expiry;
> Non-functionality of e-form saving and downloading features, resulting in repeated loss of work and duplication of effort; and
> Continued instability in various portal services, adversely impacting day-to-day compliance filings.
In view of the above, it is humbly requested that the Ministry may kindly consider providing the following reliefs:
1. Extension of validity of name reservations granted under RUN/SPICe+ until the portal issues are fully resolved;
2. Refrain from rejecting or invalidating forms pending for resubmission due to technical glitches;
3. Grant suitable extensions for statutory filing and resubmission timelines; and
4. Issuance of clarification to exempt stakeholders from non-compliance under the provisions of the Companies Act, 2013 arising exclusively due to technical glitches in the MCA portal.
We shall be grateful if’ the Ministry takes urgent cognizance of the issues and provides the necessary relaxations at the earliest.
