On the 9th of July, 2024, the Central Government, acting under sub-section (1) of section 138 of the Income-tax Act, 1961, formally specified the Agriculture Production Commissioner (APC) & Secretary to Government, Agriculture & Co-operation Department, Government of Telangana.
Section 138 of the Income Tax Act, 1961, which governs the disclosure of information about assesses by income tax authorities. Section 138 deals with the income tax authority (ITA) disclosing information about assesses upon request from officers under any other Act.
Main Provisions:
- Sub-section (1)(a) empowers the Board or any other income-tax authority to furnish information to:
- Officers, authorities, or bodies performing functions under any law related to the imposition of taxes, duties, or cess.
- FEMA Authorities (Foreign Exchange Management Act).
- Any other officer or authority deemed necessary by the Central Government in the public interest.
- Sub-section (1)(b) allows individuals to apply for information obtained during the performance of their duties under the Act. They can apply to the Principal Chief Commissioner (PCC), Chief Commissioner (CC), Principal Commissioner (PC), or Commissioner ©. The decision on providing such information lies with the specified authorities and is based on public interest.
- Sub-section (2) contains a non-obstante clause, allowing the Central Government to direct, via notification in the Official Gazette, that no information related to a specific class of assesses shall be provided by public servants.

S.O: 2661(E).—In pursuance of sub-clause (ii) of clause (a) of sub-section (1) of section 138 of the Income- tax Act, 1961, the Central Government hereby specifies Agriculture Production Commissioner (APC) & Secretary to Government, Agriculture & Co-operation Department, Government of Telangana for the purposes of said clause.
