Jaycon Homes Private Limited Vs Deputy State Tax Officer (Telangana High Court)
Telangana High Court Permits Fresh Application for Revocation of GST Registration Cancellation Despite Earlier Rejection
Summary: The Telangana High Court, in M/s. Jaycon Homes Private Limited Vs Deputy State Tax Officer & Others, considered a writ petition arising from the rejection of an application for revocation of cancellation of GST registration. The petitioner had applied for revocation on 25.03.2025 against the cancellation order dated 17.03.2025 issued in Form GST REG-19. A show cause notice was subsequently issued on 28.04.2026, more than one year after the revocation application. Since no reply was filed, the competent authority rejected the application on 12.05.2026. By then, the period available for filing an appeal had also expired.
The petitioner submitted that the show cause notice had been uploaded on the GST portal without separate intimation and that its tax consultant had not been regularly monitoring the portal. Consequently, the petitioner was unable to respond within the required period. It sought another opportunity either to submit a reply to the earlier notice or to make a fresh revocation application. The State Tax Department’s counsel indicated that the petitioner could be permitted to submit a fresh application within a stipulated period for consideration in accordance with law.
Considering the circumstances, the Division Bench comprising Acting Chief Justice P. Sam Koshy and Justice Narsing Rao Nandikonda granted the petitioner liberty to file a fresh application for revocation of cancellation of GST registration manually within two weeks. The competent authority was directed to consider such application in accordance with law without being prejudiced by the rejection of the earlier application for failure to file a reply. The writ petition was disposed of without costs. The Court did not direct automatic restoration of registration or decide the merits of the revocation request; it granted a fresh opportunity for consideration by the competent authority.
Facts of the Case
M/s. Jaycon Homes Private Limited approached the Telangana High Court after its application for revocation of cancellation of GST registration was rejected by the competent authority.
