Hitachi Digital Services India Private Limited Vs DCIT (Telangana High Court)
Telangana High Court Directs Income Tax Department to Decide Section 154 Rectification Application Within 45 Days
Summary: The Telangana High Court, in Hitachi Digital Services India Private Limited Vs Deputy Commissioner of Income Tax, considered a writ petition under Article 226 of the Constitution of India concerning the petitioner’s claim for a refund of ₹1,36,42,938 relating to Assessment Year 2006–07. The petitioner sought consideration of its application dated 03.07.2023, examination of the adjustment of the disputed amount against a refund relating to AY 2022–23, and repayment with applicable interest under Section 244A of the Income-tax Act, 1961 if the adjustment was found incorrect.
During the hearing, the petitioner’s counsel confined the request to a direction requiring the Income Tax Department to consider and decide its rectification application under Section 154 concerning the order dated 03.07.2023 for AY 2006–07. The Department’s counsel submitted that appropriate steps would be taken for an expeditious decision, subject to verification that the application was still pending.
The Division Bench comprising Acting Chief Justice P. Sam Koshy and Justice Narsing Rao Nandikonda directed the Department to verify the status of the rectification application. If the application remained pending, the Department was required to decide it within 45 days after affording the petitioner a reasonable opportunity of being heard. The Court disposed of the writ petition without deciding whether the refund adjustment was incorrect or whether the petitioner was entitled to the claimed refund and interest. Its direction was confined to verification and timely consideration of the pending application.
Background of the Case
M/s. Hitachi Digital Services India Private Limited approached the Telangana High Court under Article 226 of the Constitution of India seeking directions to the Income Tax Department regarding a refund claim of ₹1,36,42,938 pertaining to Assessment Year (AY) 2006–07.
The petitioner sought consideration of its application dated 03.07.2023 and verification of the adjustment of the said amount against a refund relating to AY 2022–23. The petitioner also sought a reasoned order and, subject to verification of an incorrect adjustment or recovery, refund of the amount along with applicable interest under Section 244A of the Income-tax Act, 1961.
During the hearing, the petitioner’s counsel made a limited request for a direction to the Department to consider and decide the rectification application under Section 154 of the Income-tax Act, 1961, relating to the order dated 03.07.2023 for AY 2006–07.
The Department’s counsel submitted that, subject to verification and confirmation that the application remained pending, appropriate steps would be taken for an expeditious decision.
High Court’s Decision
The Hon’ble Telangana High Court disposed of the writ petition without keeping the matter pending.
The Court directed the Income Tax Department to verify whether the petitioner’s application under Section 154, filed against the order dated 03.07.2023 for AY 2006–07, was still pending.
If the application was pending, the Department was directed to decide it within 45 days, after affording the petitioner a reasonable opportunity of being heard.
The Court thus confined its operative direction to verification of the application’s status and, if pending, its timely disposal. It did not adjudicate the substantive correctness of the refund adjustment or direct immediate payment of the claimed refund.
Key Takeaways for Taxpayers
- Section 154 rectification: Taxpayers may seek rectification of an order where the statutory requirements for rectification are satisfied.
- Time-bound consideration: The Court directed a decision within 45 days if the application was found to be pending.
- Opportunity of hearing: The Department must afford the petitioner a reasonable opportunity before deciding the application.
- Refund disputes: The judgment does not itself establish entitlement to the claimed refund or interest; those issues remain subject to verification and decision by the Department.
Conclusion
The decision in M/s. Hitachi Digital Services India Private Limited highlights the role of judicial directions in securing timely consideration of pending rectification applications under Section 154 of the Income-tax Act, 1961.
For taxpayers awaiting a decision on a rectification application, the case illustrates the importance of documenting the application, tracking its status and seeking appropriate relief where the matter remains undecided. The ultimate relief, however, depends on the merits of the rectification application and the applicable law.
