In re Vaishnaoi Infratech and Developers Private Limited (GST AAAR Telangana)
The Telangana Appellate Authority for Advance Ruling (AAAR) has remanded a case involving Vaishnaoi Infratech and Developers Private Limited back to the lower Advance Ruling Authority (AAR). The appeal stemmed from an AAR order that addressed only three out of six questions posed by Vaishnaoi Infratech regarding the GST implications of their land development activities. The company sought clarity on the taxability of selling developed plots, providing development services to landowners, and the transfer of development rights.
Vaishnaoi Infratech, engaged in developing plots by purchasing land or entering development agreements, had specifically requested rulings on the applicability of GST, the reverse charge mechanism (RCM), valuation of supply, and input tax credit (ITC) eligibility. The AAR provided rulings on the taxability of plot sales, development services, and the transfer of development rights, but left the remaining questions unanswered.
The AAAR, upon reviewing the appeal, determined that the AAR’s order was incomplete. They noted that the unanswered questions were interconnected with those that were addressed, making it impossible to render a comprehensive appellate decision. While the CGST Act, 2017, does not explicitly provide for remanding cases, the AAAR cited the need for justice and referenced a similar decision by the Karnataka AAAR in Myntra Designs Pvt Limited {(2022)1 Centax 78(App AAR-GST-Kar)}.
Consequently, the Telangana AAAR set aside the lower authority’s order and directed the AAR to reconsider the matter and provide rulings on all six questions initially raised by Vaishnaoi Infratech. This decision emphasizes the importance of complete and comprehensive rulings in advance ruling proceedings, ensuring all aspects of the applicant’s queries are addressed. The order also stated that the provisions of the CGST Act and the TGST Act are identical except for certain provisions.
