Pioneer Co-operative Car Parking Servicing and Constructions Society Limited Vs Senior Joint Commissioner (Calcutta High Court)

The Hon’ble Calcutta High Court in Pioneer Co-operative Car Parking Servicing and Constructions Society Limited v.  Senior Joint Commissioner, Commercial Taxes and WBGST, Burrabazar Circle and others passed an unconditional interim order restraining the respondents from enforcing the notice dated 30th September, 2024 in respect of the demand raised by the respondents in Form GST DRC- 07 for a period of two weeks from 04.10.2025 till the disposal of the writ petition or until further orders.

The Learned Writ Court was of the view that the petitioner is entitled to a conditional protection on the basis that the interim order passed would stand automatically vacated in case the petitioner makes any default in payment. The petitioner were directed to make deposits an aggregate sum of Rs. 25 lakhs in five installments of Rs. 5 lakhs each and the first of such installment being paid within two weeks from date and the balance successive installments being paid within every two weeks there from with the respondent authorities.

The petitioner was represented by Advocates Mr. Vinay Shraff, Mr. Dev Kumar Agarwal and for the State, Mr. Anirban Ray, Mr. T. M. Siddiqui, Mr. Tanoy Chakraborty and Mr. Saptak Sanyal.
