Calcutta High Court has dismissed a writ petition filed by Beacon Tiles & Ors. seeking the release of approximately Rs. 15.44 lakh in outstanding dues and security deposits from the Bidhannagar Municipal Corporation. The petition, which sought the disbursal of funds related to a work order dated September 24, 2020, was rejected due to a lack of substantiating documentation and the presence of disputed facts.

Beacon Tiles asserted that it had completed the assigned work within the stipulated period and had made representations to the Corporation without response. However, the Bidhannagar Municipal Corporation countered that the claimed amount was not an admitted liability. The Corporation further contended that no completion certificate had been presented to corroborate the alleged completion of work, asserting that the claim remained factually contested.

Court observed that no documentary evidence, including a completion certificate, was adduced to establish the completion of the construction work or that the claimed amount was an admitted sum. The Court found substance in the Corporation’s arguments, noting the absence of foundational documentation and the existence of disputed questions of fact regarding the execution and quantification of the alleged dues.
