The Chhattisgarh High Court has granted regular bail to Anish Kumar Sahu and Kanhaiya Lal Yadav, who were arrested in connection with the seizure of illegal liquor. The judgment, delivered in a First Bail Application, addresses the request for release of the two men who were booked under the C.G. Excise Act for possessing a combined total of 23 liters of raw Mahua liquor. The court’s decision was influenced by the applicants’ clean record, the stage of the police investigation, and the likelihood of a delayed trial.
The case originated on June 1, 2025, when police officers at Sipat police station received a tip-off about two individuals, Anish Kumar Sahu and Kanhaiya Lal Yadav, being in possession of a significant quantity of illegal liquor. Acting on this intelligence, authorities seized 15 liters of raw Mahua liquor from Anish Kumar Sahu and 8 liters from Kanhaiya Lal Yadav. Following the seizure, a case was registered against the two under Section 34(2) and Section 59(a) of the C.G. Excise Act, and they were taken into custody on June 2, 2025. The application for bail was filed under Section 483 of the newly enacted Bharatiya Nagarik Suraksha Sanhita, 2023, which replaced the previous Code of Criminal Procedure.
