All Commissioners of Customs.

Sub : – Notification No. 82 (RE-2008) dated 23.01.2009 – transitional arrangements thereunder and origin of goods under prohibition.

Vide Notification No. 82 dated 23.01.2009, import of toys from China appearing under ITC Codes 9501, 9502, 9503 of the Schedule 1 of ITC (HS) Classification of Export and Import Items has been prohibited.

In this regard it is clarified that, prohibition under the Notification shall be applicable on all such toys which have originated from China, irrespective of the Country of import. Originated here shall mean manufactured in China.

It is also brought to the notice of all concerned that vide this Notification transitional arrangement available under Para 1.5 of FTP have not been stopped. Thus, the transitional arrangements in respect of items whose import has been prohibited vide the said Notification shall continue. Similarly, where the import shipment has been made prior to the date of issue of this Notification, as per Para 9.11A of HBP- vI, those imports may also be allowed.

This issues with the approval of competent authority.
