NOTIFICATION NO. 44 (RE-2005)/2004-2009

NEW DELHI : DATED 10 FEBRUARY, 2006

S.O.(E) – In exercise of powers conferred by Section 5 of the Foreign Trade (Development and Regulation) Act, 1992 read with paragraph 2.1 of the Foreign Trade Policy, 2004-2009, the Central Government hereby makes the following amendments against entries in Category 0 under Appendix 3 to Schedule 2 of ITC(HS) Classification of Export and Import Items, 2004-2009 notified vide Notification No.15 dated 15.7.2005 : –

(i) Existing

0A Prescribed Substances

Note : Any radioactive material in Category 0A shall additionally attract the provisions of Radiation Protection Rules, 2004 made under the Atomic Energy Act, 1962 and the provisions of Section-16 of the Atomic Energy Act, 1962.

Note : Any radioactive material in Category 0A shall additionally attract the provisions of the Atomic Energy (Radiation Protection) Rules, 2004 made under the Atomic Energy Act, 1962 and the provisions of Section-16 of the Atomic Energy Act, 1962.

(ii) After entries 0A313, the following are added : –

0A314 *Titanium ores and concentrates (Ilmenite, Rules and Leucoxene)

0A315 *Zirconium, its alloys and compounds and minerals / concentrates including zircon.

*Note : These items (0A314 and 0A315) shall remain prescribed substances only till such time as the Policy on Exploitation of Beach Sand Minerals notified vide Resolution under 8/1(1)/97-PSU/1422 dated 6th October, 1998 is adopted / revised / modified by the Ministry of Mines or till the 1st January 2007, whichever occurs earlier and shall cease to be so thereafter.

2. The restrictions on export of items under Category 0 came into effect from the date of issue of Notification dated 18th January, 2006 by Department of Atomic Energy.

3. This issues in Public interest.
