Note below Category 1A in Appendix 3 (SCOMET items) to Schedule – 2 of ITC (HS) Classification of Export and Import Items, 2018 has been included to allow export of remnant of chemicals falling under Category 1A by the officials of the OPCW after testing / analysis.

Subject: Amendment in Export Policy of Chemicals under Appendix 3 (SCOMET items) to Schedule- 2 of ITC (HS) Classification of Export and Import Items, 2018

S.O. 4975(E).— In exercise of the powers conferred by Section 5 and Section 14A of the Foreign Trade (Development and Regulation) Act, 1992, as amended, read with Para 1.02 of the Foreign Trade Policy 2015-2020, the Central Government hereby makes amendments, with immediate effect, in the Appendix 3 to Schedule -2 of ITC (HS) Classifications of Export and Import Items 2018, as notified in DGFT Notification No.47/2015-20 dated 31.01.2018 read with Notification No. 17/2015-20 dated 03.07.2018.

2. A Note to be inserted below Table under Category 1 A in Appendix 3 to Schedule 2 of ITC (HS) Classifications of Export and Import Items 2018, will read as under :

“NOTE :

Notwithstanding above, export of remnant of chemicals, after testing / analysis in the OPCW designated laboratories, falling under Category 1A, will be allowed by way of being taken back by the officials of Organisation for the Prohibition of Chemical Weapons (OPCW) to the OPCW Secretariat or any designated authority. Such export shall be subject to the condition that for each export, officials of OPCW shall notify the details, prior to actual export, to the National Authority, Chemical Weapons Convention, Cabinet Secretariat, Ministry of External Affairs (D&ISA) and the Directorate General of Foreign Trade.”
